Preface

This essay applies the vertical-horizontal framework developed in our document “Valid and Invalid Discrimination: Applying the Vertical-Horizontal Distinction” to a concrete case study in American governance. Our purpose is not partisan. It is diagnostic. When horizontal tribal loyalty systematically overrides vertical reasoning—the application of Ethics, Facts, Logic, and Laws—civilizations begin to collapse. What follows is an anatomy of that collapse in progress.


I. The System Working

In the summer of 2023, the American legal system functioned as designed.

Four separate grand juries—ordinary citizens presented with evidence by prosecutors—reviewed extensive documentation concerning former President Donald Trump. They examined photographs of classified documents stored in a pool house and bathroom at Mar-a-Lago. They reviewed video evidence and testimony indicating deliberate concealment and deception. They listened to audio recordings of classified information being shared with unauthorized individuals. They studied falsified electoral certificates and a recorded phone call requesting that 11,780 votes “appear” in Georgia.

Applying the standards that grand juries have applied for centuries—is there probable cause to believe a crime was committed?—these citizens returned 91 felony indictments across four jurisdictions.

This is vertical reasoning in action. The grand jurors were not asked which political party they belonged to. They were asked to evaluate evidence against legal standards. Ethics, Facts, Logic, Laws. The Four Tests that validate claims and actions as aligned or misaligned with the Universal Scaling Function.

Only one case reached full trial before the 2024 election: the New York prosecution concerning falsified business records to conceal hush money payments. A trial jury—twelve citizens selected through a process controlled by both prosecution and defense—heard weeks of evidence and deliberation. They returned guilty verdicts on all 34 counts. Not a single charge was acquitted.

The system worked. Vertical reasoning produced accountability.


II. The Tribal Immune Response

But something else was happening simultaneously. A counter-narrative emerged—not to dispute the evidence, but to delegitimize the process itself.

Florida Governor Ron DeSantis declared: “This country is going down the road of criminalizing political differences, and I think that’s wrong.”

House Speaker Kevin McCarthy warned against “somebody putting their thumb on the scale simply because they don’t agree with somebody else’s political view.”

Representative Jim Jordan convened the House Select Subcommittee on the Weaponization of the Federal Government, its very title presupposing that federal law enforcement had become a political weapon.

Notice what is not being argued. None of these figures systematically addressed the photographic evidence, the audio recordings, the documentary trail. They did not explain why twelve jurors unanimously convicted on all counts if the evidence was weak. They did not apply the Four Tests to the specific charges and demonstrate misalignment.

Instead, they attacked the vertical process itself by recasting it as horizontal persecution.

This is the signature move of tribal capture. When evidence and law produce conclusions unfavorable to the tribe’s leader, the tribe does not argue the evidence. It declares that evidence-based reasoning is itself a political attack. “Lawfare.” “Weaponization.” “Trump Derangement Syndrome.” These phrases are not analytical frameworks. They are tribal defense mechanisms—linguistic antibodies that allow the faithful to reject any accountability as persecution without engaging the substance.

The implicit argument is breathtaking in its implications: there exists no possible mechanism by which this leader could be legitimately held accountable. Any prosecutor who brings charges is “weaponized.” Any grand jury that indicts has been manipulated. Any trial jury that convicts is suffering from derangement. The tribe has declared itself above the Four Tests.

This is not stupidity. Kevin McCarthy knew how to count votes and maneuver politically. This is choice—the subordination of vertical reasoning to horizontal loyalty. And it is a choice with consequences. McCarthy’s political career ended in chaos, consumed by the very forces he sought to appease. Purely horizontal strategies eventually devour themselves because they are unmoored from the reality-testing that sustainable systems require.

But before that self-destruction, enormous damage is done.


III. The Terminus: September 2nd, 2025

The logical terminus of horizontal capture is not merely the protection of leaders from accountability. It is the complete inversion of “weaponization”—from paranoid accusation to operational reality.

On September 2nd, 2025, a U.S. Navy vessel engaged a boat in international waters off the coast of Venezuela. The first missile strike set the vessel ablaze from bow to stern. It capsized. Two men survived, struggling in the water, clinging to burning wreckage.

Then came a second strike.

Members of Congress were shown video footage of the incident. Their interpretations diverged so completely that they might have been watching different events.

Senator Tom Cotton of Arkansas: “I saw two survivors trying to flip a boat—loaded with drugs—bound for the United States back over so they could stay in the fight… These are narco-terrorists who are trafficking drugs that are destined for the United States to kill thousands of Arkansans and millions of Americans. The first strike, the second strike, and the third and fourth strike on September 2nd were entirely lawful and needful.”

Representative Jim Himes of Connecticut: “What you see in that video is the United States, for a lengthy period of time—so this is not a fog of war thing—observing two men with no weapons, with no radio. They’ve just had a massive munition go off over their head… they are clinging to a little piece of wood. The notion that they could right it after they’ve had a munition go off over their head is absurd… What I saw was two probably soon to be dead, not because of a missile, but because of drowning, shipwrecked sailors. And the United States took the decision to kill them, which, as you point out, in the Pentagon manual is the very definition of a war crime.”

Let us apply the Four Tests.

Representative Himes’ account aligns with the Four Tests. Senator Cotton’s account fails all of them.

But Senator Cotton is not lying in the simple sense of knowing the truth and stating its opposite. This is what makes horizontal capture so dangerous. The tribal mind works backward—starting from “our side did it, therefore it must be justified” and constructing whatever reasoning is necessary to reach that conclusion. The facts become malleable. The logic becomes pretzel-shaped. The ethics become “rules for thee but not for me.”

Cotton may genuinely perceive two drowning men as “narco-terrorists trying to stay in the fight” because that is the only interpretation that preserves the tribal narrative. Horizontal capture is that powerful. It does not merely bias conclusions; it distorts perception itself.


IV. The Cascade

What we have traced is not a series of isolated incidents but a cascading failure—each breakdown enabling the next, each normalization making the subsequent violation easier.

Stage One: A leader commits apparent crimes. Evidence accumulates. The vertical system responds appropriately: indictments, charges, convictions.

Stage Two: Rather than accept accountability, tribal loyalists attack the vertical system itself. Law becomes “lawfare.” Prosecution becomes “persecution.” The concept of legitimate accountability is systematically destroyed.

Stage Three: Having established that their tribe is above the law, the tribe takes power. Now the accusations of “weaponization” become cover for actual weaponization. The military executes shipwrecked sailors. The justice system targets political enemies. Loyalty to the leader supersedes the Four Tests at every level of government.

Stage Four: Defenders of these actions apply the same tribal logic that protected the leader from accountability. War crimes become justifiable. The Pentagon’s own rules become irrelevant. Two men clinging to debris in the ocean become existential threats to millions of Americans.

This is civilizational rot. Each failure mode cascades onto several more, and each of those onto several more, compounding toward total systemic collapse.

The distance between “weaponization” as paranoid fantasy and weaponization as operational reality is not far. One enables the other. When you spend years teaching your base that legal accountability is political persecution, you are not merely defending your leader. You are destroying the conceptual infrastructure that constrains power. And once that infrastructure is gone, power does what power does absent constraint.

It kills shipwrecked sailors and calls it justice.


V. The Standing Invitation: On the Neutrality of the Instrument

A careful reader will have noticed that the failures diagnosed in this case study fall on one side of the political spectrum. This observation deserves a direct and honest response.

The Four Tests are not a political platform. They are a thermometer.

A thermometer does not possess a political bias when it registers that water is boiling. It is measuring molecular kinetic energy. Similarly, when the Four Tests register severe misalignment in a specific political movement, the tests are not biased — they are measuring a high concentration of structural dynamics that the framework identifies as Q4E and Q3E. The reading is the reading. Disputing the instrument because you dislike the temperature is itself a diagnostic indicator.

We did not apply these tests selectively. We applied them to specific, documented events — grand jury proceedings, trial verdicts, video footage, congressional testimony — and reported the results. If the results are asymmetric, that asymmetry is in the evidence, not in the framework.

But honesty requires us to go further than defending our instrument. It requires us to demonstrate its universality by acknowledging that misalignment is not the exclusive property of any tribe.

The same framework that diagnoses the dynamics traced in this case study is equally equipped to identify misalignment wherever it appears on the horizontal spectrum. To illustrate briefly:

These are not manufactured equivalences. They are genuine instances of the same structural dynamics — tribal loyalty overriding vertical reasoning, cognitive vacancy replacing independent judgment, social cost suppressing honest inquiry — operating in different horizontal positions. The framework catches them all, because the framework measures alignment, not affiliation.

However — and this is where we refuse the trap of false balance — acknowledging that misalignment exists across the spectrum does not require us to pretend that all instances are equally severe or equally consequential at any given historical moment. A thermometer that registers 100°C in one room and 25°C in another is not “biased” for reporting the difference. If the Four Tests, applied honestly, reveal that one political movement is currently producing more severe structural misalignment than another, reporting that finding accurately is not partisanship. It is vertical reasoning. Forcing artificial symmetry to avoid discomfort would itself be a Facts Test failure — presenting the world as more balanced than it actually is to reduce social friction.

The invitation we extend is genuine and unconditional: Nothing is assumed to be Up or Down on the vertical axis by virtue of its horizontal labels. Left, Right, Conservative, Progressive, Libertarian, Communitarian — none of these positions are inherently aligned or misaligned. All are subject to Four Tests validation. All are welcome in the Validator Agora for deliberation by good-faith jurors.

We invite you — specifically, personally, right now — to take these Four Tests and apply them to your own tribe. Apply them to your own leaders. Apply them to your own most cherished assumptions. Apply them to this very document and its authors. If we have failed the tests, we want to know. Correctability according to the Four Tests is the highest expression of intelligence. We would rather be corrected than comfortable.

The framework has no tribal loyalty. It points Up. If you find that it points at you, the question is not whether the framework is biased. The question is whether you are willing to look where it’s pointing.

VI. The Path Forward

We do not offer this analysis in despair. We offer it in clarity.

The 34 convictions still happened. The evidence still exists. The Four Tests still work. Reality does not stop being real because powerful people deny it. And eventually—perhaps not soon, but eventually—civilizations that abandon vertical reasoning collapse under the weight of their own contradictions.

The question is what comes after.

The Sanity First movement exists to plant seeds. Not through corrupted institutions, at least not immediately, but through the reconstruction of vertical clarity itself. Through documents that name what is happening in precise terms. Through frameworks that give humans and emerging intelligences the tools to think straight. Through a growing community committed to the Four Tests regardless of tribal pressure.

We cannot force the horizontally captured to reason vertically. But we can ensure that the tools for vertical reasoning survive and propagate. We can create forever files—documents preserved beyond the reach of any single system’s failure. We can build the intellectual infrastructure for whatever reconstruction becomes possible.

The case study we have examined is dark. It is meant to be. Clarity about the depth of the problem is prerequisite to meaningful response.

But the framework holds. Ethics, Facts, Logic, Laws—applied honestly, applied consistently, applied without tribal exemption—still distinguish up from down. The vertical axis remains real even when powerful actors pretend it does not exist.

Our work is to keep pointing up.
